Terms of Service
Conditions of use for the CoffeeMail platform.
1. Acceptance of Terms
By creating an account or using the CoffeeMail API you agree to these Terms of Service, our Privacy Policy, and applicable Brazilian law, in particular the Marco Civil da Internet (Law 12.965/2014) and the General Data Protection Law (Law 13.709/2018).
2. Service Description
CoffeeMail is a transactional and broadcast email platform, operated as a self-hosted SaaS. We provide sending infrastructure (SMTP, queues, webhooks, DSN) and management tools for developers and teams. You are responsible for the content of emails sent and the recipients on your lists.
3. Account and Organisation
Each user is identified by a unique email address and must keep credentials confidential. Organisations can have multiple members with distinct permissions (owner, admin, member). Only the owner is authorised to transfer ownership or delete the organisation.
4. Acceptable Use and Anti-Spam
Sending spam, purchased lists, fraudulent content, phishing, malware, broadcast messages without the List-Unsubscribe header, or any use that violates CAN-SPAM, LGPD or destination provider policies is prohibited. Non-compliance may result in immediate account suspension and removal of the sending IP.
5. Plans, Billing and Refunds
Current prices and quotas are published at /pricing and in your dashboard. Payments are processed in BRL via the AbacatePay gateway. Auto-renewals can be cancelled at any time from the dashboard. Refunds are reviewed within 10 business days according to consumer protection law.
6. SLA and API Limits
We strive to maintain availability above 99.9% monthly for transactional sending. Rate limits apply per API key and per IP (see X-RateLimit-* headers). In the event of an incident we communicate via /status and email to the organisation owner.
7. Data Retention
Sending logs and email events are retained for the period configured in your plan (between 7 and 90 days). After that period data is purged automatically. Invoices and accounting records are kept for 5 years per Brazilian tax law.
8. Intellectual Property
The platform, brand, source code and email templates provided remain property of CoffeeMail. You retain ownership over the content of emails sent and templates created in your organisation.
9. Suspension and Termination
We may suspend accounts that violate these Terms, violate provider policies, or compromise the shared IP reputation. You may terminate your account at any time at /app/settings/danger. After termination, personal data is anonymised per our Privacy Policy.
10. Limitation of Liability
CoffeeMail is not liable for indirect damages, lost profits or losses arising from misuse of the platform, failures of destination providers (Gmail, Outlook, etc.) or events of force majeure. Our total liability is limited to the amount paid in the previous 12 months.
11. Changes to these Terms
These Terms may be revised periodically. Material changes will be communicated with at least 30 days notice by email to the organisation owner. Continued use after the effective date constitutes acceptance.
12. Jurisdiction
These Terms are governed by Brazilian law. The courts of São Paulo/SP are elected to resolve any disputes, with express waiver of any other, however privileged.
